These Terms and Conditions (“Terms”) govern your use of our website www.angeleggspressions.com (the “Site”) and your purchase of our products and services from Angel Eggspressions, LLC. By accessing our Site or placing an order, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our Site or services.

1. Acceptance of Terms

By using our Site, placing an order, or engaging our catering services, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. These Terms apply to all users of the Site, including browsers, customers, and vendors.

2. Products and Services

Product Descriptions: We strive to provide accurate descriptions and images of our products. However, we do not warrant that product descriptions, images, or other content are accurate, complete, reliable, current, or error-free. Product images are for illustrative purposes only and actual products may vary slightly in appearance.

Product Availability: All products are subject to availability. We reserve the right to discontinue any product at any time. In the event that a product is unavailable after your order is placed, we will notify you and provide a full refund or offer a suitable alternative.

Colored Eggs: Custom colored Angel Eggs may experience slight color variations. Dark colors may bleed onto the white yolk filling after a few hours. This is a natural characteristic of food coloring and does not affect the quality or taste of the product.

3. Ordering and Payment

Order Placement: When you place an order through our Site, you are offering to purchase products subject to these Terms. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or product information, or suspected fraudulent activity.

Advance Notice Requirement: Due to the custom nature of our products and the time required for preparation, orders must be placed at least 1-2 weeks in advance. This allows us to source fresh eggs and prepare products to our high standards.

Rush Orders: Rush orders (less than 1-2 weeks in advance) are available subject to our production schedule and availability. A rush fee of $35 applies to all rush orders. Rush orders cannot be guaranteed and are subject to availability at the time of order placement.

Payment Terms: Payment is due in full at the time of order placement. We accept all major credit cards and electronic payment methods. All prices are in US dollars.

4. Delivery and Pickup Options

Local Delivery: We offer local delivery within a 5-mile radius of West Palm Beach for orders of $50 or more. Delivery fee is $25. Delivery areas include specific zip codes: 33401, 33405, 33406, 33407, 33409, 33411, 33414, 33415, 33417. Orders outside these zones may be available upon special request and quote.

Pop-Up Pickup: Weekly pop-up events are held every Thursday from 4:30 PM to 7:00 PM at 2620 N. Australian Ave, Suite 100, West Palm Beach, FL 33407. Preorders are required two days in advance via phone (561) 704-2628 or website. No delivery fee applies to pop-up pickups.

Nationwide Shipping: We offer nationwide shipping via insulated packaging with ice packs to ensure product freshness. Shipping costs are calculated at checkout based on destination. We are not responsible for delays caused by shipping carriers or products damaged due to carrier mishandling.

Customer Responsibility: You are responsible for being present at the scheduled delivery or pickup time. If you are not available, we will attempt to reschedule at your earliest convenience. Repeated missed pickups or deliveries may result in order cancellation.

5. Cancellations and Refunds

All Sales Are Final: Due to the perishable nature of our products and the advance preparation required, all sales are final. We do not accept returns or offer refunds except as described below.

Cancellation Policy:

  • Orders may be cancelled up to 72 hours before the scheduled delivery/pickup date for a full refund
  • Cancellations between 48-72 hours before delivery will receive a 50% refund
  • Cancellations less than 48 hours before delivery are not eligible for refund
  • Catering orders may have different cancellation terms based on the contract

Order Modifications: Changes to your order (flavors, quantities, delivery date) may be made up to 72 hours before the scheduled delivery/pickup date, subject to availability. Contact us at (561) 704-2628 to request modifications.

Quality Issues: If you receive a product that is defective, damaged, or does not match your order, please contact us within 24 hours of delivery/pickup at hello@angeleggspressions.com or (561) 704-2628. We will work with you to resolve the issue, which may include a replacement or refund at our discretion. Photographic evidence may be required.

Weather and Emergencies: In the event of severe weather, natural disasters, or other emergencies that prevent us from fulfilling your order, we will contact you to reschedule or provide a full refund.

6. Food Safety and Allergen Information

Perishable Products: All Angel Eggs products are perishable and must be kept refrigerated. Products should be consumed within 3 days of delivery/pickup for optimal quality and safety.

Storage Instructions: Upon receipt, products should be immediately refrigerated at 40°F (4°C) or below. Do not leave products at room temperature for more than 2 hours (1 hour if temperature is above 90°F).

Allergen Information: All Angel Eggs products contain eggs and soy. Some products may contain shellfish, pork, or other allergens depending on the variety. Please review product descriptions for specific allergen information. Our facility handles multiple allergens, and cross-contamination may occur.

Customer Responsibility for Allergies: It is your responsibility to disclose any food allergies or dietary restrictions. We are not liable for allergic reactions if you fail to inform us of known allergies or dietary restrictions.

7. Loyalty Program

Program Overview: Angel Eggspressions maintains a loyalty program for registered customers. Members earn points with each purchase that can be redeemed for discounts on future orders.

Points Earning and Redemption: Points are earned at a rate of 1 point per dollar spent. Points can be redeemed for discounts when making future purchases. Specific redemption rates and values will be displayed in your account.

Point Restrictions: Points have no cash value and cannot be transferred or sold. Points are non-transferable and are personal to your loyalty account.

Point Expiration: Points expire 12 months from the date they are earned if there is no account activity. We will notify you via email before points are set to expire.

Account Termination: We reserve the right to suspend or terminate loyalty accounts for violation of program terms, fraudulent activity, or abuse. Upon termination, all accrued points will be forfeited.

8. Catering Services

Catering Quotes: Catering services require a formal quote request. Quotes are valid for 14 days from the date of issuance and are subject to product availability and scheduling.

Deposits: Large catering orders (over $500) may require a 50% deposit at the time of booking. The remaining balance is due 3 business days before the event date.

Setup Services: On-site setup and arrangement services are available for an additional fee. Setup fees vary based on event size, location, and complexity. Setup services must be requested at the time of booking.

Guest Count Changes: Changes to guest count must be communicated at least 5 business days before the event. Increases in guest count are subject to availability. Decreases in guest count of more than 10% may result in adjusted pricing but will not result in a refund.

Event Cancellations: Catering event cancellations are subject to the following:

  • More than 14 days before event: Full refund minus $50 processing fee
  • 7-14 days before event: 50% refund
  • Less than 7 days before event: No refund (deposit and payments are non-refundable)

9. Intellectual Property

Ownership: All content on our Site, including but not limited to text, graphics, logos, images, product descriptions, and recipes, is the property of Angel Eggspressions, LLC and is protected by copyright, trademark, and other intellectual property laws.

Trademarks: “Angel Eggspressions,” “Angel Eggs,” “The Angel Egg Queen,” and our logo are trademarks of Angel Eggspressions, LLC. We are the original creators of Angel Eggs. You may not use these trademarks without our prior written consent.

10. Limitation of Liability

To the fullest extent permitted by law, Angel Eggspressions shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our Site or purchase of our products, including but not limited to lost profits, lost data, or lost opportunity, even if we have been advised of the possibility of such damages.

11. Governing Law and Dispute Resolution

These Terms and all matters related to your use of our Site and purchase of our products shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of our Site shall be subject to the exclusive jurisdiction of the courts located in Palm Beach County, Florida.

12. Opt-Out and Support Mechanisms

Opt-Out & Support Mechanisms

You can cancel the SMS service at any time. Just text “STOP” to the (561) 704-2628. After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again. If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly at hello@angeleggspressions.com.

13. Carrier Liability Clause

Carriers are not liable for delayed or undelivered messages.

14. Message Frequency Clause

You may receive the following types of messages from us if you opt-in to receive them:

  • Order confirmations/cancellations or anything related to your order.
  • Messages regarding pickup and drop off times for orders
  • Marketing and promotional messages

 

As always, message and data rates may apply for any messages sent to you from us and to us from you. Frequency of messages may vary related to your order updates. If you have any questions about your text plan or data plan, it is best to contact your wireless provider. Users must be 18 or older to consent to receive messages from us.
